Welcome to Mechanical Control Services. These Terms of Service (“Terms”) govern your use of our website (www.mechanicalcontrolservices.com) and the purchase or receipt of our mechanical, HVAC, and control system services.
By engaging our services or using our website, you agree to be bound by these Terms.

1. Scope of Services

Mechanical Control Services (“Company,” “we,” “us”) provides commercial and industrial mechanical solutions, including but not limited to HVAC maintenance, control system installation, and emergency repairs.

Estimates: Any price quotes provided are valid for thirty (30) days unless otherwise stated in writing

Changes: Any changes to the original scope of work requested by the Customer will require a written “Change Order” and may result in additional charges.

2. Customer Obligations

To ensure the safety of our technicians and the efficiency of the project, the Customer agrees to:

Access: Provide unrestricted and safe access to the work site, equipment, and utility controls during agreed-upon service hours.

Site Conditions: Ensure the work area is free of hazardous materials (e.g., asbestos, mold) unless specifically disclosed and handled under a separate environmental agreement.

Authorized Representative: Designate a person on-site with the authority to approve work and sign off on completed service orders.

3. Payment and Billing

Invoicing: Invoices are issued upon completion of work or according to a progress billing schedule defined in a specific project contract.

Due Date: All payments are due within [e.g., 30 days] of the invoice date.

Late Fees: Past-due balances will accrue interest at a rate of 1.5% per month (18% per annum) or the maximum rate permitted by law.

Collections: The Customer agrees to pay all costs of collection, including reasonable attorney fees, should legal action be necessary to recover unpaid balances.

4. Warranties and Parts

Labor Warranty: We warrant our workmanship for a period of [e.g., 90 days] from the date of service. This warranty does not cover issues caused by external factors, misuse, or lack of routine maintenance by the Customer.

Manufacturer Warranties: Parts, units, and control hardware are covered solely by the manufacturer’s warranty. We do not provide additional warranties on third-party equipment but will assist in processing manufacturer claims where applicable.

5. Limitation of Liability

To the maximum extent permitted by law:

Mechanical Control Services shall not be liable for any indirect, special, incidental, or consequential damages (including loss of profits, data, or business interruption).

Our total liability for any claim arising out of our services shall not exceed the total amount paid by the Customer for the specific service or project in question.

We are not responsible for damages caused by pre-existing equipment failure, power surges, or “Acts of God” (e.g., floods, storms).

6. Cancellations and Rescheduling

Service Calls: Please provide at least 24 hours’ notice to cancel or reschedule a service call. Failure to do so may result in a “Truck Roll” or “Minimum Service” fee.

Project Termination: Termination of ongoing projects must be submitted in writing. The Customer remains responsible for all labor performed and materials purchased up to the date of termination.

7. Governing Law and Dispute Resolution

These Terms shall be governed by the laws of the State of Washington. Any disputes arising from these Terms shall be resolved through binding arbitration or in a court of competent jurisdiction located in [Insert County, e.g., Pierce County].
